How can you copyright a song in India- Procedures and benefits

Composing a song requires talent, time, and effort. Not everyone has this special talent to do it. Even while finishing a song's composition, recording, and release may seem like the end result of your efforts, you should still register your song with the relevant copyright organisation to ensure its protection before concluding that your work is complete.

It's crucial to do copyright registration for songs since it's easier than ever for others to use them improperly without giving you the credit you deserve.

According to the Act and the 2013 Copyright Rules ("Rules"), you can register your song for copyright protection. There are many components in a song. A song is created with the effort of many people working together like lyricist, composer, singer and producer. However, if a person writes, composes, and sings a song, he or she may occasionally own the entire song.

Procedures for copyright registration of a song

Step 1. Fill application

Filling out the application for copyright with correct details through a copyright agency portal is the first stage in the procedure of copyright registration for songs. After that, the applicant may apply directly, or through a third party, they have authorised. You must submit the application with the necessary supporting documentation. When you file the application, a diary number is generated that can be used to track it.

Step 2. Formality check

Following the acceptance of the application, there will be a formality check or verification. This will be carried out to ensure that your work fulfils the requirements for copyright registration.

If your application is rejected during formality checking, you will receive a note asking you to provide further information.

Step 3. Waiting for confirmation

The application or request advances to the publishing stage, where third parties may object to your claim if the formality check is successful without any issues being raised or if it is successful after receiving your response to the questions raised. The period of time for considering their objections is 30 days. In the absence of any opposition, the authority will review your application. You have to go through one more stage if there is an objection.

Step 4. Hearing

Both parties will receive a report in case the copyright objection is upheld. You must provide a response before the registrar can schedule a hearing. Each party will have a chance to speak during the hearing. Your application will be submitted to the auditor for review if the hearing is decided in your favour.

Step 5. Registration granted

The Registrar will finally receive the application. Additionally, they will base their final judgement on whether or not to give you copyright registration. If they accept the registration, you will be notified and will then have complete legal rights over your song.

Why should you copyright a song?

By obtaining copyright registration for songs, you can enjoy many benefits, such as the right to copy, provide information to the public, modify, and interpret the work.

  1. Any other company or business firm can make unfair use of your work.

  2. The copyright registration certificate is valid for sixty years for the owner.

  3. Copyright infringement is a criminal offence that can be stopped by filing a police report.

  4. In the case of an infringement, a civil lawsuit may be brought where the copyright holder is located.

  5. Additionally, they must obtain permission from the owner of any other creations based on copyrighted work and, if the owner requests it, pay royalties.
