Difference Between the FSSAI License and FSSAI Registration
The Food Safety and Standards (Licensing and Registration of Food Enterprises) Regulation, 2011, governs the licence and registration of food businesses in India. According to the law, if a food business operator is engaged in the production, storage, transportation, or distribution of food goods, they must obtain an FSSAI registration or licence. Depending on the business's size and type, food licence registration may be necessary. We examine the distinction between an FSSAI registration and licence in this blog.
FSSAI Registration
Each and every operator of a small food business must apply for food licence registration. Petty food business owners include anyone who:
Produces or sells any food item themselves, or through a small retailer, hawker, itinerant vendor, or temporary stall holder;
Distributes food items, excluding catering services, at any religious or social event;
Other food enterprises, such as small-scale, home-based, or related sectors, or small food businesses, with annual revenue of less than Rs. 12 lakhs, and whose:
Food production capacity (aside from milk and milk products and meat and meat products) is no more than 100 kg/ltr per day;
milk procurement, handling, and collection capacity is no more than 500 ltr per day;
and slaughter capacity is no more than two large animals, ten small animals, or fifty poultry birds per day.
Small food business owners must file an application for registration in Form A in order to get FSSAI registered. After submitting an FSSAI registration application, the authority must grant the registration within 7 days of receiving the application or reject it in writing.
The FSSAI registration certificate includes the applicant's photo and registration information. At all times when operating the food company, conspicuously display the certificate at the location.
FSSAI Licence
For the purpose of running a food business in India, every individual or organisation that does not fall under the category of a small food business operator must obtain an FSSAI licence online. State FSSAI licences and Central FSSAI licences are the two types of FSSAI licences. The licencing authority would vary depending on the size and type of the company. Medium-sized food makers, processors, and transporters must have a state-issued FSSAI licence; large food manufacturers, processors, transporters, and importers must have a central FSSAI licence.
Compared to an FSSAI registration, the fee and process are more involved for an FSSAI licence. A Form B application for a Food licence registration should be submitted to the relevant Licensing Authority along with the required self-attested statement, affidavit, and annexures, where necessary.
The FSSAI licence is issued to the operator on a food business's request for a duration of one to five years. For getting an FSSAI licence for a longer period of time, they have to pay a higher cost. If receiving registration for one or two years, the person may apply for licence renewal no later than 30 days prior to the FSSAI license's expiration date.
Conclusion
The distinction between an FSSAI licence and an FSSAI registration is in how the business is used. Both categories differ in terms of the qualifications required for the application process. However, if your Food Business falls under the government's exempted category of food businesses, you do not need to apply for an FSSAI licence online.
