FSSAI on Registration of Foreign Food Manufacturing Facilities

 The Food Safety & Standards Authority of India (FSSAI) announced on October 10, 2022 (Monday), that it has been decided to make registration of foreign food manufacturing facilities that come under five different food categories and are intended to export such items mandatory. Beginning on February 1st of next year, FSSAI will make it necessary for Foreign Food Manufacturing Facilities to register in order to export goods or products including milk, meat, and infant foods to India. The (Food Safety & Standards Authority of India) has asked for the list of present manufacturers and those who intend to export such items to India from all appropriate authorities of exporting countries. Food Products Which required New FSSAI Regulations


The Registration of Foreign Food Manufacturing Facilities will apply to all food manufacturing facilities that export to India and fall into one of the five categories listed below:


  • Egg powder


  • Nutraceuticals;


  • Meat & meat items, including fish, poultry & their products


  • Infant food


  • Milk & milk products


Registrar's Form for Foreign Food Manufacturing Facilities


The Registration of Foreign Food Manufacturing Facilities is formatted as follows:



  1. Name of the Nation.


  1. Information on the Food Manufacturer: Address and contact information.


  1. Address and contact information for the country's competent authority for exports.


  1. The number for approval or licence granted by the appropriate authority.


  1. Product(s) to be exported to India: Name & HS Code.



What are the facilities for Foreign Food Manufacturing Registration? 


Such establishments may apply for Registration either directly or through a designated representative. The following is the documentation that requires for FSSAI registration applications and renewals:


  • Documents similar to registration or licence that have been issued by the relevant country's authority


  • Owner's approval of the Foreign Food Manufacturing Facility for the FSSAI officials' verification


  • compositions in the depth of goods or things


  • The authorised representative's authorization (in case applied through an authorised representative)


  • any further information or documentation that the Food Authority or FSSAI may require.


Application for Registration of Foreign Food Manufacturing Facilities


The procedure for registering foreign food manufacturing facilities is broken down into the following steps:


  • First, the Foreign Food Manufacturing Facility may submit an application for registration using Form-16 of these regulations. This application must be submitted with all necessary documentation listed in Annexure-2 and the appropriate registration cost.


  • After submitting the application form, be sure to include the required paperwork and the application fee for the FSSAI.


  • The applicant will be notified to provide any additional information or to complete the application form, as applicable, within 30 days of such notice, if the FSSAI determines after reviewing the application form that it needs more information about the application or if the application for Registration is incomplete. The application for the Registration of Foreign Food Manufacturing Facilities shall be refused if the applicant does not provide the necessary information within the allotted time.


  • After receiving the application and any required further information, the FSSAI may process the examination application, issue the Registration, or reject the application.


  • The FSSAI has the authority to inspect foreign food manufacturing facilities as needed. 


  • Certain food categories must be covered by the BIS Certification Mark Scheme, according to the Food Safety & Standards (Licensing & Registration of Food Businesses) Regulations, 2011, which also include the standards listed in Schedule 4 of those regulations. 


If so, there is no need for an inspection.


  • If deemed essential, these facilities may also be evaluated after the Registration Certificate has been issued.


  • The relevant Ministry, Department, Organization, or recognised auditing agency, as well as FSSAI officials, must be nominated by the FSSAI to inspect such facilities.


  • If necessary, the FSSAI may impose inspection fees; these must be approved by the foreign food manufacturing facility.


  • The Foreign Manufacturing Facility (Food Manufacturing) that is determined to be in compliance with the FSS Act and the Rules and Regulations enacted thereunder must register for a period of two years and provide their Registration No. in Form-17.


  • After taking corrective measures, the manufacturing facility whose application was denied or rejected may reapply for registration.


  • Renewal of the registration of foreign food manufacturing facilities must be submitted on Form 16 no later than 30 days prior to the registration approval's expiration date.


Conclusion


Before exporting to India, foreign food production facilities that fall within the aforementioned categories and wish to export such food goods must register with the relevant Food Authority. Additionally, the FSSAI has asked all responsible authorities of exporting countries for a list of current manufacturers and those planning to export such items to India.
