How to Transfer an FSSAI License in India?

A food licence is an extremely important component of the food industry since it provides confirmation that the products you are providing to your customers are of the highest calibre. The law makes a licence a requirement. It is necessary to pass legislation on safety and cleanliness in order to supply hygienic meals to the public. Before opening a food business in India, a food business must complete the registration process for a food licence.

You must provide information about your company's type, product category or formulation, manufacturing capacity, and other factors when you register. FBOs (food business operators) are required to notify India's food safety and standards administration of any modifications within a certain period of time (FSSAI).

Food preparation, serving at various points before it reaches customers, such as raw materials, packing, packaging, production, delivery to canteens, and businesses with the legal right to market them, all require FSSAI food registration. For individuals who provide services from their houses, it is required. You must register with the FSSAI if you are making money off of it.

Various classes of Licenses

Businesses can apply for a basic FSSAI food safety registration if their annual turnover is less than Rs. 12 lacs. Businesses with annual turnovers between Rs. 12 lacs and Rs. 20 lacs can apply for a state licence, and businesses with annual turnovers over Rs. 20 lacs can apply for a central licence.

Changes/transfers/alterations in the license

If the FSSAI licence has already been granted, there are several procedures you must follow in order to change it. The FSSAI licence or registration cannot be changed without the filing of an application. FSSAI registration is sufficient for small businesses, while an FSSAI licence is necessary for large-scale food operations. Though what if the FSSAI holder passes away?

Any family member or legal representative of the person who passed away with the FSSAI licence may receive the FSSAI licence. The legal family member or agent should request that the certificate be transferred in his or her favour to the appropriate authority. After proper verification, the authorities may decide to accept or reject the application. However, the FSSAI licence authority cannot reject the application without giving the applicant a chance to be taken into consideration.

The FSSAI licence would only continue to exist in the event that the legal agent or any family member applied to transfer the registered certificate or licence holder's certificate. The FSSAI certificate expires if it is not presented within three months of the licence or registration certificate holder's expiration.

NOTE: Only in the event of the licence holder's passing will a certificate or licence be transferable.
